General terms and conditions
 

Art 1. General
Lirio De Agua BVBA (also referred to as “Lirio De Agua” and “Lilyandthelady.com”), located in Binkom (Belgium), Parijsstraat 33, VAT 0821 619 692, RPR Leuven 0821 619 692 offers their customers the opportunity to buy clothing accessories and jewelry through the online shop www.lilyandthelady.com.

Art 2. Acceptance
All purchases of articles on the electronic Lirio De Agua BVBA trading site are governed by these General Terms and Conditions ("GTC") which the customer declares accepting without reserve. The terms of this agreement apply unless stated specifically otherwise by Lirio de Agua BVBA. Please note that these terms and conditions may be updated from time to time.

Art 3. Prices
Prices are expressed in Euros and are only valid on the date of order. Lirio De Agua may modify article prices at any time. Only the price displayed on Lilyandthelady.com is authoritative between the parties. The displayed price includes VAT but does not include delivery costs. The VAT-tarif applied is the Belgian. The price for the article applies on the items as described. The  pictures included are purely decorative and can contain elements that are not included in the price.

Art 4. Offer
For the moment, the goods are only available for purchase by customers living in the European Union. The articles are only for normal consumer use. Even though the website is managed with care, it is possible that  info is incomplete or contains faults beyond Lirio De Agua BVBA's control.
Therefore, Lirio De Agua BVBA can only be held responsible for available stock if an error in the database occurs. However, the customer will be informed within 24 hours subsequently to ordering if an article is not available.

The  customer will then be entitled to cancel his order and obtain reimbursement of amounts paid within 30 days at the latest subsequently to settlement thereof or exchange the article.

If you wish to reach us with certain questions concerning the product, we ask you to contact our customer service (see art. 13)

BVBA Lirio De Agua reserves the possibility to decline orders for any reason whatsoever. Lirio De Agua has the right to adjust the delivery period, split up the delivery or add certain obligations to fulfill a delivery in case this is necessery. When this occurs, Lirio De Agua will inform the customer using any means.

Art. 5 Payment Methods
To pay an order, the customer can use the payment methods specified when placing an order. The customer places his/her order on Lilyandthelady.com, using the specified procedure. The purchase is made when the customer receives a confirmation e-mail from Lirio De Agua.

Online order confirmation constitutes an electronic signature which has the same legal value as a handwritten signature between Lirio De Agua and the customer.

The sale will only be valid once Lirio De Agua has confirmed the order. Any new order will only be taken into account further to the customer's correct payment of amounts possibly outstanding from previous orders.

Online payment enables the customer to pay the order using a bank server in a secured environment.The 3-D secure system makes sure the data are handled securely, based on the programmes Verified by Visa and MasterCard® SecureCode™. Payments are handled through the software of Ogone, market leader when it comes to secured online payment. The order validated by the customer will only be considered as definitive once the bank payment centre has validated the transaction.

Lirio De Agua reserves the right to cancel or suspend any order and/or delivery in the event of credit card payment authorisation refusal by the customer's bank or if a commercial dispute exists with customer.

The customer has the choice between the following payment methods:  VISA, Bancontact/Mister Cash MASTERCARD en MAESTRO.

Art. 6 Property Statement
The goods remain the exclusive property  of Lirio De Agua up until the customer has payed the full price. After the goods have been delivered, the risk of loss or damage is the responsibility of the customer.

Art. 7 Delivery
Goods are delivered on the shipping address the customer has indicated and according to the conditions that are agreed. The delivery deadline starts when the confirmation e-mail is sent. In Belgium, a customer will receive the goods within five days. In Europe, deliveries can take up to ten days. When the customer declines a delivery or when there are incorrect data in the delivery address, the package will be held or resend. The costs will in this case be payed by the customer. If the customer receives the  delivery outside of the delivery deadline and does not wish to receive the goods, we refer to article 10 in this document.

Art.8 Penalties for non-payment
In case the customer fails to pay purchased goods, they are obligated to pay an intrest op 10% each year on the amount. The customer is obligated by law to pay a  forfaitaire schadeloosstelling of 10% of the total amount, with a  minimum of 25 euro for each invoice. BVBA Lirio De Agua has the right to take back articles that have not been payed (in full).

Art.9: warranty
Legal warranty (only for customers) 
Under the Act of September 21, 2004 of the customers ‘protection regarding sales of consumer goods, the customer has legal rights. Each article is subject to the legal warranty starting the date of purchase (if applicable delivery to) the first owner. Any commercial warranty leaves these rights without prejudice.

Art.10: General
In order to invoke the warranty, the customers must be able to show a proof of purchase. For items that were purchased online and that were delivered to the customer’s given delivery address, the customer needs to contact the customer service department, (sales@LilyandtheLady.com), after which the customer will have to return the goods at his costs to BVBA Lirio De Agua. The repair of an item doesn’t give the right of reimbursement. Every default needs to be reported within a month of detection. After which, every right for free repair or exchange will be voided. The (commercial and/or legal) warranty is never valid on defaults that were created because of accidents, negligence, falls, abnormal or incorrect usage, use of the item for other purposes it is intended for, changes or modifications made to the item, hard-handed usage, bad maintenance. It’s also not applicable on items with a shorter lifespan. The warranty is non-transferable. 

Art.11: Complaints
All visible damages and/ or qualitative deficiencies of an article or any other fault with delivery have to be alerted immediately, otherwise the customer loses its rights.

Art.12:  Deficiency of Validity – Non-waiver
If any given provision of these Terms is declared invalid, unlawful or voided, they will not in any way affect the validity, legality and applicability of other provisions. Failure at any time by BVBA Lirio De Agua to enforce the right of one of these conditions, or to use the rights of any of them, will never be seen as a waiver to these terms and will never affect the validity of these rights.

Art.14: Privacy and Security
BVBA Lirio de Agua commits to use your information solely for the implementation of the contract that you are accepting by placing your order and the data you’ll receive from Lirio De Agua at will. Would you also like to receive information through e-mail, please subscribe to the newsletter.

We are considering your data as strictly confidential and will never forward, loan or sell them to a third party. You can check, correct, change or erase the information we have on your behalf in the Lirio De Agua client list at any moment and you can refuse that Lirio De Agua uses your contact details to send you information. The customer is responsible for maintaining the confidentiality of their login details and the use of his password. Lirio De Agua strictly respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data.

Art.15: Links
The website www.LilyandtheLady.com can refer to other websites of third parties. BVBA Lirio De Agua is not responsible for the content of these links.

Art.16: Proof
The customer accepts that electronic communication and back-ups can serve as proof.

Art.17: Applicable law - jurisdiction
The Belgian law is applicable, with exception of the Terms of the International Privacy law about applicable law and with the regulations of Vienna about international sales agreements regarding goods. If eventual conflicts the courts of Leuven (Belgium) are solely competent.

Art.18: Non-commercial use
This site is for your personal use only. You may not modify, copy, distribute, display, perform, reproduce, publish,  commercially exploit, create derivative works from, transfer, or sell any content, software, products, or services contained within this site. You may not use this site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site unless agreed othrewise. The pictures on this site may be used for non-commercial purposes on the internet if you link back to www.Lilyandthelady.com.
